How will the patent dispute between Intel and VLSI end?

A US appeals court has overturned a $2.2 billion arbitration award that VLSI Technology had obtained against Intel. This is one of the largest overturns in the history of U.S. patent law.

The court upheld one patent infringement but reversed another and remanded the case to redetermine the damages owed by Intel.

• In 2021, a Texas jury awarded VLSI $2.18 billion after concluding that some technologies in Intel microprocessors infringed two patents VLSI obtained from NXP Semiconductors.

• Last week, the U.S. Court of Appeals for the Federal Circuit found that there was insufficient evidence for the jury to decide on one of the patents and reversed that decision.

• The Federal Circuit continued to affirm that Intel had infringed the other patent, but requested a new trial to resolve issues in assessing damages.

• Intel plans to argue that the VLSI patent sent back for trial is “also of little value.”
